RIGHT TO REFUSE:
Yoseek.com reserves the right to refuse any banner advertising requests, or to cancel advertisements that do not fulfill the terms of this agreement and/or conform to the technical specifications. Yoseek.com does not accept advertising requests from organizations promoting products or services related to adult material, alcohol, tobacco, firearms, gambling, racism or any illegal material.

INDEMNIFICATION FOR LIABILITY:
Advertiser is solely responsible for any legal liability arising out of or relating to the advertisement, and/or any material linked through the advertisement. Advertiser represents and warrants that the use, reproduction, distribution, or transmission of the advertisement will not violate any criminal laws or any rights of any third parties, including, but not limited to, such violations as infringement or misappropriation of any copyright, patent, trademark, trade secret, music, image, or other proprietary or property right, false advertising, unfair competition, defamation, invasion of privacy or rights of celebrity, violation of any anti-discrimination law or regulation, or any other right of any person or entity. Advertiser agrees to indemnify Yoseek.com and to hold Yoseek.com harmless from any and all liability, loss, damages, claims, or causes of action, including reasonable legal fees and expenses that may be incurred by Yoseek.com, arising out of or related to advertiser's breach of any of the foregoing representations and warranties.
Your Landing Page Must Not contain Popups/Popunders Etc.

DELIVERY OF ADS:
Yoseek.com will make a good faith effort to begin displaying banner ads on the start date if applicable. However, advertiser understands that by the nature of online advertising, the advertising campaign's exact start and end dates and the rate of daily impressions delivered may vary due to fluctuations in daily traffic.

REFUND:
Any amount paid is not refundable. Yoseek.com will only provide a refund in the event we do not advertise your banner ad for any reason. If you're purchasing banner ads for the first time, we recommend that you buy a smaller amount for testing purposes.

LIMITATION ON DAMAGES:
In no event will Yoseek.com be liable to the advertiser for any special, incidental, or consequential damages, whether based on breach of contract, tort, negligence, or otherwise, and whether or not Yoseek.com has been advised of the possibility of such damage.

ENTIRE AGREEMENT:
These standard terms sets forth the entire understanding between the parties and supersedes prior agreements and representations between the parties, whether written or oral, regarding the subject matter contained herein.

Furthermore, advertising statistics are provided as-is without any guarantees. Yoseek.com shall not be liable for any claims as they relate to the advertising statistics.
